1. Agreement

Ghostcoded LLC ("we," "our," or "us") operates ghostcoded.com and all applications, products, and systems built or operated by Ghostcoded (the "Service"). By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements.

3. Account Registration

You may need to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our discretion.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these terms. You will not:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit malware, spam, or harmful content
  • Attempt to gain unauthorized access to the Service or related systems
  • Use the Service for any fraudulent or abusive purpose

5. Fees and Payment

  • Payment is due according to the billing cycle (e.g., monthly, annually)
  • We use third-party payment processors. By subscribing, you agree to their terms
  • Refunds are handled in accordance with our refund policy
  • We may change fees with reasonable notice; continued use after changes constitutes acceptance

6. Intellectual Property

The Service, including its design, content, and software, is owned by Ghostcoded LLC or its licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

7. User Content

If you submit content (e.g., profile information, feedback), you grant us a non-exclusive, royalty-free license to use, display, and process that content as needed to provide the Service. You represent that you have the right to grant this license.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOSTCODED LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Ghostcoded LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may terminate your account at any time through the Service or by contacting us. Upon termination, your right to use the Service ceases immediately.

12. Changes

We may modify these terms at any time. We will notify you of material changes by posting the updated terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance. If you do not agree, you must stop using the Service.

13. General

  • Governing law: These terms are governed by the laws of Delaware, USA
  • Disputes: Any disputes shall be resolved in the courts of Delaware
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect
  • Entire agreement: These terms constitute the entire agreement between you and Ghostcoded LLC regarding the Service

14. Text Messaging

If you opt in to text messages from Ghostcoded, you agree to the following:

  • Message types: We may send account, service, appointment, and transactional messages, plus marketing or promotional messages if you opted in to those.
  • Opt out: Text STOP to the number that sent the message to unsubscribe. You will receive a confirmation that you have been unsubscribed.
  • Opt back in: Text START to the same number to resubscribe.
  • Help: Text HELP to the same number, or email tanner@ghostcoded.com.
  • Carrier liability: Carriers are not liable for delayed or undelivered messages.
  • Rates: Message and data rates may apply.
  • Frequency: Message frequency varies.
  • Privacy: How we handle your information, including text-messaging opt-in data and consent, is described in our Privacy Policy.
